JoMO Website Terms & Conditions

Welcome to the JoMO website (hereinafter: “the Website”), operated by JoMO, Reg. No. 342541950 (hereinafter: “the Company”). The Website serves as a brand site and a blog/vlog platform in the fields of fitness, yoga, and Pilates, as well as an online store offering JoMO products and lifestyle/fitness items.

 

By accessing, browsing, registering, purchasing, or otherwise using the Website (hereinafter: “the Use”), you explicitly agree to these Terms & Conditions (“the Terms”) and to any additional terms appearing on the Website from time to time. If you do not agree to these Terms, you must refrain from any Use of the Website.

 

The Terms are drafted in masculine form for convenience but apply equally to all genders and to singular/plural. Headings are for convenience only and do not affect interpretation. The Company may update these Terms at any time, at its sole discretion. In case of conflict, the updated Terms on the Website shall prevail, subject to applicable law.

 

 

1. Services on the Website

 

The Website presents and offers for sale products of the JoMO brand and may also feature products from other brands and collaborations.

 

By registering to the Website and/or newsletter, the customer consents to receive marketing and promotional messages by email in accordance with Israeli Communications Law. The customer may unsubscribe at any time by emailing shopjomofitness@gmail.com or via the unsubscribe mechanism in each email.

 

 

2. Eligibility to Use the Website

 

Any individual or legal entity may use the Website, provided that all of the following conditions are met:

    1.    The user is legally competent to enter into binding contracts;

    2.    The user is at least 18 years old;

    3.    The user holds a valid Israeli ID and address;

    4.    The user has a valid email account;

    5.    The user holds a valid Israeli credit card issued in Israel by a recognized credit company and/or an active PayPal account.

 

The Company may, at its sole discretion and without explanation, restrict or block any user’s access, temporarily or permanently, including (but not limited to) in cases of: violation of law, breach of these Terms, provision of false information, fraudulent activity, harm to the Website/Company/other users, blocked credit card, resale intentions, or abuse of coupons/vouchers. A blocked user may not re-register under a different account.

 

 

3. Permitted & Prohibited Use

 

The Website may only be used for personal, lawful purposes in accordance with these Terms. Prohibited uses include:

    •    Commercial use (e.g., wholesale purchasing for resale);

    •    Publishing advertisements or commercial content;

    •    Copying, distributing, duplicating, or displaying content without authorization;

    •    Any use that disrupts the Website’s operation or harms other users;

    •    Linking from/to illegal or immoral websites.

 

 

4. Registration

 

Before purchasing, the customer must open a user account and provide: full name, email, password, phone number, and delivery address. Additional details may be required.

 

The Company will store personal information in its database and will not share it with third parties without consent, except as necessary to complete an order (e.g., suppliers, Israel Post, courier services). Credit card details are not stored. Sensitive data and passwords are encrypted.

 

The customer is responsible for providing accurate details, updating them, and safeguarding their password. Logging out after use is recommended to prevent unauthorized access.

 

 

5. Product Purchases & Payment

 

Customers may add products to their cart and proceed to checkout, where additional delivery details and comments may be required.

 

Payments are processed securely via MAX Business (Max It Finance Ltd. and/or affiliates) and/or PayPal, under PCI-DSS and SSL encryption standards. The Website does not store credit card information.

 

An order confirmation will be sent automatically to the customer’s email but does not constitute a binding commitment until stock availability and payment authorization are verified. The Website’s system records serve as conclusive proof.

 

If items are out of stock, the customer will be contacted to update or cancel the order (with a full refund if canceled). If a transaction is declined by the credit company or PayPal, the customer must resolve payment within 7 days or the order will be canceled.

 

 

6. Delivery & Shipping

 

Orders paid in full and approved will be shipped to the address provided. Standard delivery time is 5–7 business days from confirmation and payment, unless otherwise stated. Business days exclude Fridays, Saturdays, and holidays.

 

Delivery is made via courier services and is subject to their terms (coverage areas, timelines, etc.). The Company is not responsible for delays caused by force majeure or circumstances beyond its control (e.g., strikes, roadblocks).

 

Shipping fees are paid with the order. In case of special/exceptional delivery (e.g., requiring extra staff), additional charges may apply—these will be explained and agreed upon in advance.

 

Couriers may require the credit card holder’s presence, ID verification, and signature.

    •    If delivery is delayed, the customer must immediately notify the Website by email. If confirmed as non-force majeure, the customer may cancel and receive a full refund.

    •    Cancellation after dispatch requires the customer to return products at their own expense in usable condition, after which a refund will be issued, minus shipping fees and any non-returned/damaged items.

    •    Orders returned due to incorrect details provided will incur double shipping charges.

    •    Self-pickup is available (by appointment) within 14 days of confirmation, free of shipping charge. Failure to collect within 14 days cancels the order, and the customer will receive a store credit voucher equal to the order amount. No cash refund will be given.

 

 

7. Customer Cancellations

 

Orders may be canceled in accordance with the Israeli Consumer Protection Law, 1981, by notifying the Website or emailing shopjomofitness@gmail.com.

 

Orders for customized/personalized products or other items excluded by law cannot be canceled.

    •    Cancellation period: from the order date until 14 days after receiving the products, or (for self-pickup) within 14 days of the “ready for collection” notice.

    •    For cancellations after dispatch, products must be returned at the customer’s expense, in original packaging, unused, and in resalable condition, with the original invoice. Refunds will be issued after inspection, deducting: shipping fees, return collection fees (if any), the value of items not returned or returned in non-resalable condition, and a cancellation fee of up to 5% of the order value or 100 NIS (whichever is lower).

    •    If products are defective or not as described, the customer is entitled to a full refund or replacement. Defective items must be returned for inspection.

    •    Items purchased on sale or clearance may only be returned/exchanged within 24 hours of receipt.

 

 

8. Cancellations by the Company

 

The Company may cancel an order, in whole or in part, before delivery, for any reason. Notice will be given by email/phone. If payment was taken, it will be fully refunded.

 

If cancellation is due to payment refusal (credit card/PayPal) and the customer fails to resolve it within 7 days, no notice is required.

 

If an order was canceled due to uncollected self-pickup within 14 days, the customer will receive a store credit voucher only (no cash refund).

 

If items are out of stock, equivalent alternatives may be offered. The Company bears no liability for damages resulting from cancellation.

 

 

9. Responsibility for Use & Products

 

Use of the Website, product selection, suitability, and usage are entirely the customer’s responsibility.

 

Product descriptions and images are for illustration only; variations in color, size, or features may occur. Subject to law, the Company’s liability is limited to refunding or replacing defective products arising from gross negligence in storage/shipment.

 

Refunds or credits require presentation of the purchase invoice. No credit will be given for free items (gifts/bonuses).

 

 

10. Website Availability & Technical Issues

 

The Website is provided “as is.” The Company does not guarantee uninterrupted or error-free service and is not liable for internet/communication disruptions. Links to external websites are provided for convenience only, with no responsibility for their content.

 

 

11. Privacy & Data Security

 

The Company respects customer privacy.

    •    Personal details (excluding credit card information) are stored securely in the Website database.

    •    Credit card details are processed via third-party clearing systems under PCI-DSS and SSL standards.

    •    Data may be shared only with suppliers, postal services, or couriers to complete orders, or if required by law/court order.

    •    Customers may view and update their personal details in their account. Incorrect details may prevent order fulfillment.

    •    The Company may use anonymized data for statistical purposes.

    •    While reasonable security measures are taken, absolute immunity against cyberattacks cannot be guaranteed. Customers are advised to keep their password confidential, change it periodically, and log out after each session. Cookies may enable automatic login from the same device.

 

In cases of unauthorized access or force majeure, the Company shall not be liable for damages caused.

 

 

12. Intellectual Property

 

All Website content (text, images, videos, graphics, design, trademarks, logos, etc.) is the exclusive property of the Company. Any copying, duplication, distribution, or use without prior written consent is strictly prohibited.

 

 

13. Indemnification

 

Any user violating these Terms or acting unlawfully in connection with the Website shall indemnify and compensate the Company for any damages, expenses, or losses incurred, including legal fees.

 

 

14. Amendments

 

The Company may amend these Terms at any time, at its sole discretion. Continued Use of the Website constitutes acceptance of the updated Terms. Users who do not agree must cease using the Website.

 

 

15. Governing Law & Jurisdiction

 

These Terms shall be governed by the laws of the State of Israel. Exclusive jurisdiction lies with the competent courts in Tel Aviv, unless the Company decides otherwise.

 

 

16. Customer Service
